Community Association Law

Community Association law is a core practice area for Daughtry & Jordan, P.C. and we take great pride in delivering the highest quality legal service to our Association clients. We have developed a unique approach to the collection of delinquent maintenance assessments and deed restriction enforcement that our clients have found to be very successful. We insist that all but the most routine of a homeowner's phone calls be returned by a lawyer, not a paralegal or legal assistant. Our belief is that if the issue is important enough to write a letter about, it is important enough to merit an attorney's attention. We have found that we are much more likely to reach an amicable resolution with the homeowner if he or she deals directly with an attorney as opposed to a paralegal or legal assistant. If you have entrusted your legal work to our firm, we believe that trust mandates that an attorney perform the important work involved.

Another aspect of our practice which we think is in your best interests is that we refuse to represent homeowners in disputes against Community Associations. The only exception to this rule is where the residents are actually trying to take control of their own Community Association away from a developer-controlled Community Association. In our opinion, it is not a good practice to represent homeowners as well as Associations because it results in an unfair use of knowledge learned at one Association's expense to the disadvantage of another. Additionally, one of the services we offer our clients is our attendance at a one hour executive session of the Board of Directors each year at no charge to the Association. This is a good opportunity to exchange information, clear up any issues that might need to be resolved, and just generally to get to know each other on a more personal level. This is particularly valuable when there are new members on the board.
